Halo 3: ODST will only be released on the Xbox 360. The are currently no plans to make Halo 3 or Halo 3: ODST available on any other console other than Xbox 360.

All Halo games are Microsoft products. Nintendo and Sony are competitors with Microsoft, so it is unlikely that you will see a Halo game for any other console than XBox/XBox360/etc. for the foreseeable future.

Someone can choose not to boot you, or the system sees it as an obvious accident, and it is looked over. Other than that, just try not to kill your teammates.
