The general description is that your can't be engaged in "Substantial Gainful Activity" which for 2012 is $720 per month. Never try to be clever about "month" and split a large paycheck into two months, the limit can be applied to any 30 day period. If self-employed then there is an additional limit of 80 hours of work per month, whether or not you made any money.
If your earnings exceed $720/month and you are eligible for a trial work period of up to 9 months you can earn more and still get SSID benefits $1,010 in any month for most, $1,690 if blind. A trial work period is limited to a total of 9 months in a 60 month period. If you had a trial work period in 1992 or earlier you may need to ask SSA to confirm your eligibility.
Payments to volunteers in certain programs, and only those programs, are excluded from (not counted towards) the limits; Volunteers in Service to America, University Year for ACTION, Special Volunteer Programs, Retired Senior Volunteer Program, Foster Grandparent Program, Service Corps of Retired Executives, and Active Corps of Executives.
Pay in connection with a government subsidized back-to-work or job training program is counted against the limit, but only the part of the pay that exceeds the government subsidy is counted against the limit. You should check the details before you start the job to avoid being surprised later.
Work and payments in connection with consulting services provided under the Federal Advisory Committee Act are also excluded from the limits, but only if you are a member or consultant of an advisory committee specifically authorized by statute, or by the President, or determined as a matter of formal record by the head of a federal government agency, and you weren't required to do it as part of some other job.
For more details see the SSA web site and Federal Regulation 404.1574. "Evaluation guides if you are an employee." which doesn't seem to have been updated since 2000 and doesn't have the explicit the hour limits for the self-employed found in the more recent SSA regulations.
SSDI Work rules consist of three "steps"; SSDI - STEP 1 - Trial Work Period · Nine "Trial Work Months" where you may earn as much as they want and still receive your SSDI cash benefit. · Trial Work Months are not consecutive, used when earnings exceed $700 in a month, if all nine are used within a 5 year period then you would move on to step II. · It is in your best interest to keep track of your own Trial Work Month usage. · The Purpose of the Trial Work Months is an opportunity to "test" your ability to work, in order to see what works for you. SSDI - STEP 2 - Extended Period of Eligibility · Extended Period of Eligibility or EPE (Step 2). · 36 month time frame (3 years) which begins once you complete your last (9th) Trial Work Month. · If earnings reach SGA ($980) in one calendar month, then you are not eligible to receive your SSDI cash benefit for that month, if earnings fall belowSGA the next month due to your disability then SSDI cash benefits are resumed. · EPE continues to roll regardless of employment situation SSDI - STEP 3 - Post EPE (After completion of Step 2) · Once you have completed the 36 month Extended Period of Eligibility (Step 2), you may continue to receive SSDI cash benefits until you earn over SGA. · Once earnings exceed SGA, termination of benefits occurs. · It is also in the best interest of the beneficiary to understand when, and when they are not eligible for a SSDI cash payment. Expedited Reinstatement - Safety Net Provision · If SSDI (or SSI) has been terminated, then due to a change in your medical condition (related to original claim) you are unable to be gainfully employed. You may request reinstatement of benefits within 60 months (5 years) from day of termination. · You will receive 6 months of provisional benefits while a SSA review is completed. · If found ineligible, no repayment is expected but you can elect to file a new claim Please contact your local WIPA (SSA- Work Incentive Program and Assistance project) for more information.
People on disability can earn up to $1,000 per month ($12,000 per year) for most disabilities, or $1,640 per month ($19,680 per year) for anyone legally blind. Earning more than these limits would be considered engaging in Substantial Gainful Activity (SGA), would trigger a continuing disability review, and likely result in an end to the person's disability status with Social Security.
Any month a disabled person earns more than $720.00 is counted toward the nine-month trial work period, and may result in a continuing disability review (CDR).
