Lincoln originally released a preliminary version of the Emancipation Proclamation on September 22, 1862, which declared that in southern states that didn't return to the Union by January 1, 1863, slaves would be free. The second version was released on January 1, 1863; it basically said the same thing as the first one, but went on to name ten specific states to which it would apply. It is significant that the border slave states of Maryland, Delaware, Kentucky and Missouri, all of which had remained in the Union, were exempted. So also was Tennessee, which was coming increasingly under Union influence. Virginia was included in the proclamation, but the 48 western counties which were then in the process of forming their own state (West Virginia) were exempted.

The Emancipation Proclamation actually freed very few slaves at first -- only around 20,000 out of some 4,000,000. The document has been criticized as having little effect, and as being a political stunt designed to help the Republicans in the 1862 mid-term elections. (It probably didn't.) Its obvious shortcoming was that it applied only to areas not then under Union control, and didn't apply at all to the northern states.

As more and more of the South came under Union control during the Civil War, increasingly more slaves were freed. Around 200,000 blacks served in the Union Army during the war. Toward the war's end, several states voluntarily passed laws or amended their constitutions to outlaw slavery, including Maryland and Missouri.

It wasn't until a few months before his death that Lincoln persuaded Congress to enact what later became the Thirteenth Amendment to the US Constitution, which abolished slavery completely in the entire nation. In January, 1865, the proposed amendment was submitted to the states and by December of that year it became the law of the land. Around 40,000 remaining slaves in Kentucky and Delaware were liberated then.
