The city of Fremantle lies just south of Perth, at the mouth of the Swan River, and was the first city in Western Australia. Dutch captain Willem de Vlamingh named the Swan River in 1697 because of the black swans he saw in abundance there. In 1829, Captain Charles Fremantle was sent to take formal possession of the remainder of New Holland which had not already been claimed for Britain under the territory of New South Wales. On 2 May 1829, Captain Fremantle raised the Union Jack on the south head of the Swan River, thus claiming the territory for Britain. The colony of Western Australia was proclaimed in June 1829, and two months later, Perth was also founded. The first ships with free settlers to arrive were the Parmelia on June 1 and HMS Sulphur on June 8. Three merchant ships arrived 4-6 weeks later: the Calista on August 5, the St Leonard on August 6 and the Marquis of Anglesey on August 23. Although the population spread out in search of good land, mainly settling around the southwestern coastline at Bunbury, Augusta and Albany, the two original separate townsites of the colony developed slowly into the port city of Fremantle and the Western Australian capital city of Perth. Fremantle was also where the first load of convicts to Western Australia arrived. The first group of convicts to populate Fremantle arrived on 1 June 1850. Between 1850 and 1868, ultimately 9721 convicts were transported to Western Australia.

some convicts were treated really badly and others were treated very good, they were not truly free until they gained a free trust. some convicts earned enough trust.

No amendment prohibits the early release of convicts. For a while, civil rights legislation prohibited certain states from releasing convicts early. Thus, New York could sentence a person to prison for 8 to 12 years. In Florida, the sentence would be 8.5 to 10 years. Florida was prohibited for giving the same amount of time off for good behavior.
The health of the First Fleet convicts was surprisingly good, and better than subsequent fleets. Captain Arthur Phillip considered the needs of the convicts, ensuring that there was sufficient lime juice to help prevent scurvy. Phillip did not condone violence towards or abuse of the convicts. The First Fleet had the best record of all the other fleets for health and treatment of the convicts.
