No you dont its called Spousal privilege which comprises two parts:Part One:::The marital confidences privilege (or marital communications privilege) is a form of privileged communication protecting the contents of confidential communications between a married couple. This privilege applies in civil and criminal cases. The verb to waive simply means to refrain from taking something that one has the right to have. An example would be when one gives up their right to having an attorney present while being questioned by the police.
A particular statement or insertion (i.e.: a clause) in a document in which one party to the document either reserves, or gives up, (depending on the wording) the right to dispute, the privilege of waiving the contents of whatever information is contained within the document.
