Firstly - a disclaimer. I'm not a Policeman or a lawyer, or even particularly knowledgeable. However, I'm researching into something similar and so may be able to help...
(EDIT: I've now realised that site is mainly used by Americans - so this may not be much use. Sorry!)
It would depend on what Section of the Road Traffic Act you are charged under. The offence under Section 41D of the Road Traffic Act 1988 (as amended by the Road Safety Act 2006) is that you are using a handheld device, and results in a statuary 3 points.
The other one is an offence under section 3 (driving without due care and attention). The penalties for this are a fine, between 3 to 9 points, and even disqualification - plus you have to go to court...
In the United States most states are still smart enough to realize that driving whilst using a phone is not an issue. A few left leaning states have felt the need to ban or limi ohone use. Texting is a far different issue though. Text messaging is a real problem and should ban banned everywhere.
YES!! you can crash and die!!
Careless driving, dangerous driving, depending on the severity of the accident.
The "business" that does this is called the police. Administering the law should not be a commercial business!
more than 3600 people are killed each year through mobile phone use whilst driving
using ur mobile phone when driving
Don't use cellphone while driving ! Edit: Absolutely agree with the first answer. In the UK it's ILLEGAL to use a cellphone while driving. The current penalty is 6 points on your licence and £60 fine - for a first offence. You CAN lose your licence for repeat offences. WHY would you be using a mobile when driving anyway - If you're operating a vehicle, your SOLE responsibility should be complete concentration on the act of driving NOT using a mobile phone ! People DIE because drivers see their mobile phone as more important than paying attention to the road !
Using a mobile phone without a hands-free device while driving is illegal in many places. Texting while driving is especially dangerous.
This depends on your cell phone carrier. Contact your carrier for this information.
Depending on what country you are in when you are caught, if you are not using a hands-free phone you may be fined and/or have an endorsement or points on your driving licence. In the UK it's a £60 fine and three points. If you cause an accident then the penalty will increase, and may include a lengthy prison sentence. It is reckoned that driving whilst using a phone is as hazardous as driving whilst drunk. Using a hands-free phone has little change in this risk, as your concentration is still distracted from the road. As a motorcyclist I often see drivers holding a phone to one ear and as a result not looking to that side when they are manoeuvring or pulling out into my path. Similarly, pedestrians with a phone clamped to their head are likely to step into the road without looking round.
no all belongings most be handed over before entering custody
When it's not safe to do so... for example - whilst driving, or operating machinery.
No, also you can't drink and drive or be on the phone whilst driving.
