If an agreement is reached and a document containing the agreement typed up by the mediator and signed, the parties are bound to that agreement. Typically, a mediation agreement awards money to an injured party. If mediation fails, the parties may proceed to court and litigate the issue. Many states require parties involved in an auto accident dispute to attempt mediation before filing a court case. If, however, the case proceeds to court, the judge or jury will calculate the amount of damages, if any, and award the amount to the injured party.
