it would be smarter to ask them to replace it though. Lawyers are more expensive than your tv and you'll have a hard time proving that your tv was in better condition when you brought it to them than when you took it out. trust me. I work at a pawn shop and suing is a waste of time and money on your part. Only try to sue as a last result. ASK THEM TO REPLACE IT OR GIVE YOUR MONEY BACK FIRST!!!
