UK answer.

Assuming the driver/employee was at fault. it would be their fault totally.

Even if the vehicle was unroadworthy, it is the drivers legal responsibility to check the roadworthyness of the vehicle before driving it.

If it was a third parties fault, then any action should be taken against them.

You are covered for the duration of the original certificate unless the vehicle fails on items deemed to make the vehicle immediately dangerous and unroadworthy. The testing station can deem it illegal for the vehicle to be used on the road. If you drove it under those circumstances your insurance would be invalid and you would be committing an offence. You would have to leave the vehicle for repairs or have it towed or recovered to a place for storage or repair.

If the new car does not comply with the specifications of the advertisement, or if it is clearly unroadworthy yet it was sold to you as roadworthy, or if it has some fault or damage, then you have valid legal grounds for returning it.

But if you have simply changed your mind and just don't want it anymore, then you have no legal basis for returning it, and you will have great difficulty in persuading the dealer to give you your money back.

However, if you now wish to buy a another, more expensive, car from him, he might be interested in doing a deal with you!
