There are three main branches in the United States Government: The executive, the legislative and the judicial.
The legislative branch of government is made up of Congress and other governmental agencies. The Constitution gave this branch the power to make laws. The Congress has two parts: The House of Representatives and The Senate. The main function of the legislative branch is to enact laws and to exercise control over government action.
The Executive Branch makes sure the laws are obeyed. The President is the head of this branch. The Executive Branch of government is responsible for delivering programs and services to the population within the framework of laws, expenditures, and tax measures approved by Legislature.
The Judicial Branch of government is made up of the court systems. The highest court is the Supreme Court. The courts decide arguments, constitutionality of laws, and how they are applied.

The US Government operates under the authority of the US Constitution. As a democratic republic the Federal government has what is known as a balance of power. This was the way the founding fathers made certain as best they could, in not letting one branch of the government dominate over the other branches. Additionally, to avoid the Federal government to have too much power, the US Constitution grants the central government powers written in this document. All other powers are left to the States to decide. For example the US states make laws concerning capital punishment. The Bill of Rights within the Constitution states that punishments should not be overly cruel. The US Supreme Court currently has not determined that any state violates the unduly cruel part of the Constitution.
