Depending on your state laws the punishments will vary. However, if the child hit the other until he killed, maimed, or severely injured him then there would have to be a punishment. Most likely the child would have to go to a reformatory (not a real prison) or the parent would be held responsible and he would go to prison instead.
In Ohio, a child may not fight back. My nephew's mother hit and kicked him. He then pushed her away from him and she fell. His father (my brother) picked him up and took him to the police station to file charges against the mother. He was advised not to press charges, because if he did, my nephew would be arrested and charged with assault because under no circumstances is a child to 'attack' an adult.
A parent may spank a child for discipline but kicking is going too far and she could probably get into legal trouble for that. So if a child get disciplined him attacking back would be assault. And in the case above it is clearly not a 9yo we are talkijng about but perhaps a 16yo. If a 9yo hits you back they would not get arrested and if it happened regularly one would send the child to a doctor to be evaluated. A 16yo who is probably the same size as the woman is different and should have better judgment that a 9yo. Although using spanking to a 16yo is not appropriate in my book.
