It all depends on opinion. Mine would be the legendary Manaphy. Others, like previously stated, would be Empoleon. Or possibly Lumineon.
During a battle you must have at least one Pokemon out at all times. If you only have one in your party and you were to withdraw it, there would be no one left in the fight. If that was your intention, try fleeing the battle instead.
No, Kyogre is not the biggest Pokemon. According to the Pokedex, Wailord is the biggest. Wailord evolves from Wailmer at level 40. Second biggest is Steelix. if your pokemon is level 45 and over and you would like to train it go to the elite four and get to the guy or girl your pokemon is super effective on then battle it .

I would recommend Ludicolo for its Rain Dish ability is very useful especially if you are in a double battle with a Kyogre.

Best non-legendary water pokemon would be Gyarados. Best legendary water pokemon is Kyogre.
Well, first off you can not capture Kyogre in Pokemon SoulSilver, only Groudon. The only way you can get Kyogre in Pokemon SoulSilver is by trading. However if you had Pokemon HeartGold you would have to first obtain the Blue Orb from Mr. Pokemon. But to do this you must have: -Obtained the National Dex -Defeated Red on Mt. Silver -Obtained a starter from Professor Oak Next you would need to take the Blue Orb to a cave in Route 47 called The Embedded Tower. You would then have to make your way through the cave to find Kyogre at the end at Lv 50. It is the same process for getting Groudon in Pokemon SoulSilver except instead of the Blue Orb you would get the Red Orb.
The only way besides using a cheating device (eg. gameshark), would be to save just before initiating a battle with said Pokemon and keep battling it and resetting until you encounter it as a shiny (this would only work with Pokemon you walk up to to start a battle, like Kyogre or Groudon). The chances of a Pokemon being shiny are one in 8192, so you may be there a while. Good luck, you'll need it.

lugia can use thunder(I think), and kyogre can use ice beam. Lugia would win because if one of them used rain dance,thunder would hit. If lugia couldn't use thunder, kyogre would win. Kyogre can use thunder and ice beam and Kyogre's ability causes it to rain so thunder would not miss. Kyogre would win if they were even stats and even trainer skill level.
