§ 165.40 Criminal possession of stolen property in the fifth degree.

A person is guilty of criminal possession of stolen property in the

fifth degree when he knowingly possesses stolen property, with intent to

benefit himself or a person other than the owner thereof or to impede the

Basically you have been charged with misdemeanor theft by shoplifting. If you received a ticket/summons go to court on your assigned day.

Is it legal to be topless in Central Park NY?

Yes, it is. Although Article 245, Section 01 of NYS Penal Law ("Exposure of a person") states that it is illegal for women to go topless in public unless they are breastfeeding, the NYS Court of Appeals ruled in the 1992 case, People v. Santorelli, that this law constitutes gender discrimination and is thus unconstitutional.Article 245, Section 01 states that, "a person is guilty of exposure if he appears in a public place in such a manner that the private or intimate parts of his body are exposed," and that, "[f]or purposes of this section, the private or intimate parts of a female person shall include that portion of the breast which is below the top of the aereola."The NYS Court of Appeals ruled that, "exposure of a bare female breast violates this law only when it takes place in a commercial context," (as with topless waitresses). So, yes, it is legal for women to go topless anywhere in New York State, although they may be arrested anyway by cops who are unfamiliar with People v. Santorelli.Article 245, Section 01 can be read in its entirety at the Related Link below. A link to the court's findings can also be found there.
