she is probably naming him as having custody incase both you and she are passed away before your 8 yr old is 18, this may be to ensure he has a loving place to stay should that be the case. other wise dad needs to obtain joint custody.

Only the legal guardian can sign so if the parents are divorced he can sign if he has full legal custody. Otherwise not.
