The Senate has sole authority to confirm or deny Presidential nominations. This is granted by the Nomination Clause of Article II in the U.S. Constitution.
The Constitution provides that when the President dies or otherwise cannot perform his duties as President, the vice president will then serve as President. This continues until the President is healthy or, in the event of a presidential death, until the next election cycle.
The Articles of the Constitution failed for more than one reason. One of the reasons the constitution failed was because of failing to provide political and judicial mechanisms for the protection of rights and failure to abide by the articles rules.
