It depends on where it happened. In some states in the US, it could be a "mitigating circumstance." That means the full penalty might not be applied. The court would have to believe that (a) the minor deceived you with a phony ID (not just by saying they were of age) and/or (b) the minor appears to an objective observer to be of age (not just "close" or "maybe" of age, but unquestionably of age).
Even so, you almost certainly will pay some penalty, and in most states you will wind up on a "sexual offender" list.
