As long as you legitimately own the software, it's not actually illegal to modify it. It may technically be a violation of the EULA. If you're talking about copying it for unauthorized distribution... yeah, that's illegal. If you own Mario kart as in like Nintendo do, you can hack it. If you own copyright permission from NINTENDO then you can mod it. If you illegally get codes from the internet to hack in then its illegal. Using action replay is legal.
You can't legally download Nintendo Gameboy ROMs online for free unless Nintendo specifically gives permission. It is considered illegal but rarely will any action be taken against you.
