Yes it is against the law, If its your mom and your under 12 that's not child abuse, if your over 12 parents can't hit you or you could call child care, but since he's not your real dad , then it is against the law.
I'm not sure that the above answer is correct. The laws concerning whether parental discipline can include corporal punishment or not (i.e. smacking) vary from country to country. Also, whether a "step" parent, of sorts, is allowed to discipline a child with consent from the parent would also be different. Depending on where you live, these actions may or may not be illegal.
Of course, if by hitting you are not referring to just a quick smack for disciplinary purposes, this may very well be child abuse.
