I own a direct mail coupon magazine and I ran a advertisement for a carpet cleaner company. He had ran with me before, so when I stopped by his house and ask him if he wanted to run his ad with me, he said yes. After that I have spoke and got text from him about payment. Now he says he's not going to pay me. I had an oral contract with him to run his ad. Is he liable to pay me?
In most states verbal agreements are NOT legally binding. But the act of moving in and paying the rent, and your landlord giving you the unit and accepting your rent, are a presumption of an agreement to the terms of rental. But specific terms cannot be enforced because there is no lease. For example a landlord cannot say he doesn't allow pets or subleasing and kick you out because you violated those terms, if there is no lease specifying them. A verbal lease is month-to-month. Any changes to such requires a notice of at least the number of days according to the frequency at which the rent is due. If the rent is due every week, then a week's notice must be give before the next rent is due; in the case of monthly rental, the notice must be given at least 30 days before the next rent is due. The same type of notice, according to frequency, must be given for a tenant to vacate the premises.
Usually once a year, or whenever a lease, or a verbal agreement is renewed. That's for New York State, where I am a landlord. Other states or even counties may differ on the issue.
Not legally, the legal age of majority in the state of New York is eighteen.
