Depends on the state and the circumstances of the crime. In IL, it could be a Class A Misdemeanor or a Class 4 Felony. The misdemeanor would have less than a year of jail time, the Felony could have prison time of 1-3 years. But again, that's just IL. You would have to look up the laws in your own state.
