Greatly depends on when, where and what the circumstances involved were. Sentencing guidelines take into effect many factors. Was the person assaulted unharmed, injured, maimed or nearly killed? First offense or third?

Depends on the state and the circumstances of the crime. In IL, it could be a Class A Misdemeanor or a Class 4 Felony. The misdemeanor would have less than a year of jail time, the Felony could have prison time of 1-3 years. But again, that's just IL. You would have to look up the laws in your own state.

720 ILCS 5/12-2
