Impeachment means to bring a formal charge of criminal wrongdoing against an elected official (you are thinking of the President). It does NOT mean trying them. The House of Representatives conducts Impeachment proceedings. If the President were impeached by them (has happened 2 times) then the President would be tried by the Senate.
Impeach means to bring charges against the holder of a public office, usually the president. The House of Representatives has the power to impeach, while the Senate decides whether or not to remove from office.
5 times since the inception of the house.
Impeachment requires only a simple majority in the House. The Senate then holds a trial and serves as the jury and here it takes a 2/3 vote of those Senators present and voting to convict and remove the president from office.
The House of Representatives impeached Johnson by a vote of 126-47, mostly cast along party lines, with the Radical Republicans demanding impeachment. Johnson was acquitted at his Senate trial, where the vote was taken three times in an effort to resolve the 35-19 deadlock that was one vote short of conviction. Although the Radical Republicans held enough seats for conviction, several members crossed the aisle and voted to acquit the President because they didn't like the way the impeachment and trial was handled.
Once. The House Judiciary Committee attempted to impeach President Andrew Johnson in August 1867 on vague charges, but the resolution was voted down by members of the House. The Judiciary Committee's second attempt at impeachment, on eleven articles that were mostly related to the Tenure of Office Act, in February 1868, was successful when the House voted 126-47 in favor of the resolution.
It has always been the law that the Vice President assumes office if the President dies or is incapacitated. This has happened eight times since 1788. There has never been a case where the VP, becoming president, is also killed or incapacitated. The closest thing ever to happen like this was when Nixon was President and Spiro Agnew was VP. Agnew was corrupt, and resigned as VP to avoid impeachment. President Nixon nominated Gerald Ford to be VP, and when Nixon resigned to avoid impeachment, Ford became president. Ford is the only person to be president who was never elected as President or VP.
yes they can- until they resign or are removed under a case of impeachment... this also applies to all senators.
