Power of Attorney is to give the sibling mentioned and acknowledged by the mother to perform their affairs when the mother cannot such as paying bills; investing money, etc., and no one else can take the right away from the Power of Attorney mentioned since the mother requested this person, not even the sibling who is 40 years old and living at home. Once a parent dies the Power of Attorney no longer exists and the Executor (male) or Executrix (female) named will put the Will into Probate which will pay off any debts before the Estate is settled and any property or monies left will be divided as the parent's Will stated.
If the property was transferred before death, it's over. There isn't anything you can do about it so don't even think about it any more.
Your mother's estate must be probated in order for her property to pass to you legally. You should consult with an attorney who can handle the estate and also act as your gatekeeper to keep your pushy sibling at bay.Your mother's estate must be probated in order for her property to pass to you legally. I am not positve if a sibling can watch over another sibling when a parent is away. But I Know for a fact that if one of siblings is at least 12 the child stay home by themselves. So if one of the siblings is at least 12 i think tht sibling can watch over the other sibling while a parent is away.
my aunt left me property in her will, and now I would like to sell the property, but I don't have a clear deed. how do i get a clear deed to the property so that I can sell the property?
No. While your mother was alive you were living at her home with her permission. The executor has no authority to go back and charge you rent since the executor had no authority over the property before your mother's death.No. While your mother was alive you were living at her home with her permission. Furniture is movable. Most fixtures are immovable, but check with the agent what is to be left in a property you are taking over.
Yes they can due to left over hormones from the mother.
Her estate is responsible for her debts. That means any property she owned at the time of her death should be paid over to her creditors. If there is no estate then the creditors are out of luck.

Sometimes it's competing over the attention of a parent. Sometimes its the little sibling wanting to be like the bigger sibling.
