I too am in this boat! My ex has not followed any directives in the order for parenting time , child support, family debt or Tax debt. I have kept up on my taxes and for the past several years, All my tax returns were with held and applied to my ex spouses federal debt, what ever that means! Tax court is not governed by family court so "they say!" So they will go after the money any way they can. I was in a low income bracket in the middle of this past decade and the tax debt tripled with fees and interest. An unreasonable cycle that feels like prison. No getting free from this. As long as both of them stay there and the other spouse shows no objection, there is no problem. But if there is a disagreement or objection from a spouse, he or she can proceed with a divorce petition in Indian Court for purpose of jurisdiction that the marriage took place in India. This question reads like two issues. But, the main thing is that the mom can approach the legal side of things to see if she can get her child back--and have a court order regarding custody.

i believe if you took the order out on the person then it is no longer good to use , and this depends on the state your in, I know here if I had a court order against someone and then I talked to them, the order is no longer good

The question is very unclear. I am going to guess that you hold a power of attorney from your spouse, whose mental condition is altered. The spouse's children are concerned that you are looting the property of your spouse and converting their inheritance into your own property. On those facts, they certainly can have your power of attorney revoked, have themselves appointed as guardians of your spouse, and sue you to make you explain what you have done with every penny of the spouse's money that you took up under the power of attorney. If it appears that you took the spouse's separate property (i.e., not marital property) and you cannot show that you spent the money on the care of the spouse, then expect to spend time in prison. Florida protects its senior citizens with as much vigor as a bear protecting its young.
You can take possession, but without a court order, you do not have custody. You will need to file a child in need of care motion with the court. Are you the father or someone else?
