Depends on where your backyard is located, and what is around you. I deer hunt in my backyard in Virginia- but I live in the country, and my back yard is 30 acres of woodlands. If you are in a city, the answer is probably no.
The answer is probably not, depending on where you live. Most places have restrictions on the use of firearms. Cities and towns particularly, where homes are close together. Many restrict any sort of weapon that shoots anything larger than a BB. The types of weapons that may be used in specific areas of the state may be subject to state laws.

No. Because, in order for you to shoot them you would have to get their permission to shoot them. If you accidentally shoot somebody inside your backyard without their permission, it is their fault for being in the yard with someone that has a paintball gun and is shooting it in the first place.
