Yes, you can be prosecuted for fraud if you tried to sell something that you didn't have. If you collect money for something and don't deliver, you obtained it under false pretenses. In addition, because it is the internet, it could be a federal crime. You could get arrested and you can get sued.

As of Nov.-Dec. 2008 there is no Legal way to get anything BUT previews of Twilight. Unless you want to get in trouble with the law I suggest you not try to get it on DVD or anything.
