A licensed driver may drive with 3 people in the front seat only if: 1) the seat is wide enough for 3 people without interfering with the driver's access to the controls (steering wheel, gear shift lever, accelerator pedal, brake and clutch (if so equipped) pedals, and without blocking the driver's view of the rear view mirrors; 2) the vehicle has been equipped with a seat belt for the third passenger, and 3) the passenger side air bag is designed and located in such a way to protect both passengers. An infant seat should never be used in either the center or right side of the front seat of a vehicle, unless the vehicle is a pickup truck which does not have a rear seat. In addition, many pickup trucks are equipped with a switch to deactivate the passenger side airbag when a rear-facing infant seat is used.

If you have bench seats in the back (as opposed to stow and go seats) you can buy a second large seat, remove the short one that holds 2 people and put in the large seat in its place. Then you have a seat at the very rear that can seat 3 people, a seat in the middle that can seat 3 people and the 2 in the front. 3+3+2=8. And yes, the driver is considered a passenger.
