It will depend on a variety of factors. For example, recent case law allows marriage by proxy in countries which recognise that procedure (Brazil being one) so an illegal immigrant could marry a British citizen in their home country without the need for the bride or the groom to be present (that is the proxy element). In addition, the European Convention on Human Rights says that the right to marry is inalienable, so it cannot be said that an illegal immigrant cannot marry here. However, marriage does not guarantee a right to stay in the country. For marriages taking place in the UK, a Certificate of Approval must be acquired first if a person is subject to Immigration controls (The exception being if you are both Anglican and marry in an Anglican religious ceremony - then you do not need permission from the UKBA) Illegal immigrants who marry by proxy, in an Anglican religious ceremony, or who satisfy the UKBA that they should be allowed to marry will still have to apply for a "Further Leave to remain" visa which can be denied for any number of reasons. After 2 years, providing you meet the relevant criteria, you can apply for "Indefinite Leave to Remain" which again, can be granted or refused at the UKBA's discretion.

AnswerNo Marriage does not legitimise immigration status. Even if the immigrant was legal, he/she would still have to apply for a Certificate of Approval to marry within the UK. The Home Office prefers applications for marriage to be made from outide the country.

Yes it is possible now but you have to prove to the ukba that you two are really in love and that you have been living together, the best time is photos, documents to prove how long you been living together and if you get all this right, the likelyhood of staying in the UK is great but where are you going to marry because registrars would want your identifications. to apply its free of charge you don't pay no visa fee and you will be given 5yrs stay in the UK and after that you can apply for ilr. my friend did it and he is on his 5yrs visa.

Marriage to an Illegal AlienVery few states have laws that do not allow the marriage of a US citizen to a illegal foreign national. The non citizen must have the proper indentification, however, and that would include a valid Social Security number. If the person can supply the required identification then the marriage is considered legal.

A citizen spouse can no longer file a permanent resident petition or citizenship application for a non citizen spouse if said spouse entered the US illegally. The non citizen spouse will be required to return to their country of origin and file for reentry under US immigration laws and USCIS procedures.

As such, he/she must have a valid I-94, an entry stamp in his passport, a visa. This is just preliminary because the couple must have to subsequently prove to the U.S. Immigration that the marriage is genuine and was entered into not as a way to evade immigration regulations and laws.

I only know that in Buncombe County, NC you may be wed with someone who has no documentation what so ever. The only thing that they say is, "you have no Social Security Number or nothing?" and you reply no and they make the person who has no ID sign an affidavit that they have never received a social and you pay the license fee and then you are married.
