Article 2 Section 3 Clause 1 of the US Constitution states "He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient;". The State of the Union speech satisfies this duty by tradition; however, the President does not have to give an actual speech.
