IT is up to the employee to request the accommodation, under the law. Reasonable accommodations might include a wheelchair ramp, or a special desk at wheelchair height. The federal EEOC (Equal Employment Opportunity Commission) enforces this law. Generally, an employee cannot be fired simply for being disabled. However, if the employee is unable to do his or her job, even with accommodations, then the employee can be fired. If this is truly a layoff situation, where the employer is reducing staff or closing a plant, disabled employees have no special protection under the law. They can be laid off just as any other worker can. The employer has the right to end your employment at anytime through a layoff. In the US employment is deemed to be at will. This means employment is presumed to be voluntary for both parties and employers are allowed to protect themselves financially though layoffs.
