There are many factors involved. Jail implies that the individual will be kept for less than a year. Prison is used for longer periods of time. Was there a battery involved, or only an assault? Was there a weapon involved? Were there other crimes occurring at the time such as robbery? Was it a night, was it against the opposite sex, etc.
