Normally no bank will pay a post dated cheque, as payment of a post-dated cheque does not amount to payment in due course (Section 10 of the Negotiable Instruments Act, 1881) and if it pays the bank run the risk of payment being stopped by the drawer before its presentation on the due date. In addition to this, a banker has NO mandate to debit the accounty of the depositor before the due date. Hence normally a bank will not pay a post-dated cheque.
However, if the salary of, say, college /school teachers, etc., are being received every month by a bank for creit of the accounts of the school/college teachers, in some extra ordinary cases, the bank may take a calculated risk and pass the cheques if it knows that their salary will be realised after a few days. It all depends on the decision of the branch head and the amount of risk he would like to take and the type of relations exist betweeen the teachers and the bank people.
