Yes you can, but your have to prove it. You can base your divorce on your spouse's cheating. I live in British Columbia, Canada and it wasn't easy getting a divorce in the 1970's. I hired a detective to get the evidence on my husband although I had caught him cheating on my own. When I did I left him, filed for divorce on those grounds and hired a detective.
There may be some obscure law which says that the husband can sue his wife because of her adultery but I have not heard of it. The husband has grounds to sue his wives lover if intercourse has taken place, and it causes the marriage to break up. The husband will no doubt benefit by what the wife must let him take from the home, even the home itself.
No doubt someone more familiar with the laws regarding your question, may be more qualified to answer it to your satisfaction.
Your spouse can take it away at any time. The court would certainly believe that you would not be representing the best interests of your spouse at that point.

The victim of a cheating spouse should never make it easy for the cheater to come back into their lives and continue on as if nothing has happened, but, they should not harp at the cheating spouse or the relationship would wither away. To err is human and sometimes either men or women make a mistake and cheat, but some never cheat again while others may find themselves cheating over and over again. This is why it is important for the victim of cheating to tell their spouse they will only take them back if they agree to go to marriage counseling where the marriage counselor can give them the tools to correct the weak areas in the marriage. If the cheating spouse refuses, then it is better to walk away from the marriage.
