If I understand the question correctly the answer is yes. An employer can have a Health Reimbursement Arrangement as the mechanism to pay for employees health care. In those plan documents the employer can specify what they will reimburse for (ie insurance premiums, Rx, dnetal etc). If the plan is established such that they only pay for insurance premiums then they are generally under no obligation to pay for out-of-pocket expenses for an employee that has no insurance.
