The market is incapable of measuring need; it can only measure willingness to pay, and willingness to pay is determined more by wealth than by need: If gasoline is $100/gallon, Paris Hilton can still easily fill her generator to run her hair dryer, while a poor family can't afford enough gasoline to keep their dialysis machine running. Rationing is a better solution to shortages.
Even with anti-gouging laws, shortages already produce disincentives, such as gas lines, to deter people who don't truly need the resource.
