It matters if you buy a digital download online from Microsoft and download it or download it from a website.

if it is a website it will most likely be a virus that may steal information from your computer such as bank details. It is also illegal.

If it is from the Microsoft website your safe it is totally legal

If you are downloading it from a torrent using a third party torrent program (bit torrent, U torrent) it most likely wont be a virus but is still illegal.

Short answer. It is illegal.

but you could still do it if you want there is an extremely low chance that you will get caught.
