Federal law 18 U.S.C. § 922 states the following: "...prohibits the shipment, transportation, receipt, or possession in or affecting interstate commerce of a firearm by one who: has been convicted of a misdemeanor crime of domestic violence; has been convicted of a felony, or any other crime, punishable by imprisonment for a term exceeding one year."
The law does not differentiate between a DUI felony and any other felony. A DUI will not automatically preclude you from owning a gun or obtaining a permit in most states, however, A felony DUI will, because it is a felony. The only exception to that is a felon who has had his or her rights restored. That is not particularly easy to do, and judges normally only restore some rights, not necessarily all.
I have a Felony DWI that is 19 years old, I have had ALL of my rights restored without ANY firearm restrictions, also I was placed into the FBI'S VAF. I also hold a NYS CCW permit as well. Have a great night! :)
I didn't say it never happened. I implied that it wasn't that common. I know a whole bunch of people that were denied when trying to restore their rights.
