No, the President does not have the power to declare war. That power is reserved to Congress by Article I, Section 8. The President is empowered to deploy troops for limited purposes and limited periods of time under the War Powers Act, but he has no power to declare war.

The Emperor of the Daleks created a group of Daleks to "think like the enemy thinks", in other words, figure out ways of killing, technology and ways of survival that no normal Dalek could think of. They were called 'The Cult of Skaro'. They had to be 'un-dalek' so the Daleks could become more efficient, not only physically but also mentally. They became so 'un-dalek' that they became ememies of the Emperor, as the Emperor believed they were going too far. Dalek Caan (along with Dalek Sec, Jast and Thay) was one of them. When the Cult killed Sec (the leader) after becoming part human, Caan was appointed leader. When Dalek Thay and Jast were destroyed by humans, the Cult of Skaro was eradicated and Caan escaped using a teleportation system known as the 'Emergancy Temporal Shift'. He went back in the time war and rescued Davros (the creator of the Daleks) from his death (Davros was killed in the "Time War" but Caan saved him). Dalek Caan had the whole of time and space in his mind and became a "mad prophet". Seeing what the Daleks have done and what they were, he betrayed the Daleks and helped the Doctor by destroying them. In a way, he died doing his duty; thinking like the enemy thinks.

Davros created them, however they tend to overthrow him. In the classic series they apparantly kill him, he turns up in a later episode though. In the 7th Doctor story 'Remembrance of the Daleks', there are two Dalek factions, Imperial Daleks under the Dalek Emperor, and Renegade Daleks under the Dalek Supreme. The Emperor in this case turns out to be Davros however. At the end of the 1st series of the rebooted Doctor Who, the Dalek Emperor is shown, he survived the Time War and rebuilt an army. They are destroyed by Rose Tyler however. During series 2 and 3, four other Daleks are shown to have survived the Time War. They are the Cult of Skaro, specially designated Daleks with their own names and imagination. They are lead by a black Dalek, Dalek Sec. In the 4th series, another Dalek force has been assembled, lead by a Supreme Dalek. Davros is here also, though he is simply being kept for his scientific expertise. In the 5th series, a 'New Paradigm' of Dalek is created. They are colour coded, the white one is the new Supreme Dalek. In series 7, 'Asylum of the Daleks', the Daleks have a parliament and a prime minister.
The Daleks were a widespread empire consisting of billions of individuals, only a mere handful escaped each time, knocked into different time periods by the conflict, but mostly able to rebuild their race on arrival. The Time Lords on the other hand were much fewer, and more insular, sharing the same fate as each other. As far as escaping the time war goes, it has been shown that both dalek and time lord alike have been able escape from it, in different ways. One plot point was that things from inside it can escape under some circumstances - the 'lock' really only prevented outside interference. Daleks, - The single dalek in 'Dalek' was a survivor from the Time War. - Dalek Emperor's ship escaped it. - The Cult of Skaro used a Void Ship to escape it. - Dalek Caan entered and exited the time war, bringing the dalek creator, Davros (A Kaled). Note - The three 'Ironside' Daleks from 'Victory of the Daleks) did not escape the Time War. They were survivors from the destruction at the Medusa Cascade. Time Lords, - The Doctor didn't technically escape it, more like ended it. - The Master was resurrected during it but fled from it. He used the chameleon arch to become a human and hid at the end of the universe. - The Time Lords themselves engineered a plan by which Gallifrey itself would be rescued from the time war. It was thwarted by the Doctor and the Master. The 'rules' of time are constantly being rewritten or excepted by later episodes, which means it's possible another time lord can appear later on, meanwhile the Daleks have re-established themselves as a democracy of all things, though time will tell if the new paradigm are as aggressive as the past versions.
