Creative Photography is fine art photography. In fine art photography, there are no rules. Its sole purpose is artistic value, providing the artist a medium through which to express themselves.
It certainly can be. It depends on the way you take the picture, and what you take the picture of. We see a continuous panorama. A photograph takes a small part of that panorama and freezes it. Some times that photograph is just documentation, like most pictures of houses for sale, for example. Other times it communicates feelings, emotional states, or just a pleasing arrangement of colors. It always represents the photographer's choice.
Of course, once the picture has been taken, it can be manipulated in the darkroom or using software like PhotoShop. This can make it an image that doesn't exactly correspond to any reality. That is an additional level of creativity.
It is an art because it takes skill and technique and is a creative outlet.
