The Declaration of Independence does NOT establish any rules for governing the country. There was no country as we know it when we declared our independence. The constitution establishes our rules for governance. The legislative branch makes and passes laws for governance, when they are passed the executive branch (president) signs (or not) them into law. If someone doesn't like a law then they have the right to challenge it in court, i.e. the case may go all the way to the Supreme Court. The Supreme Court is supposed to make rulings on these cases based on their interpretation of the Constitution. Just like Roe vs. Wade (the landmark abortion case). This case was not argued on the basis of "abortion" or the taking of a "life", because the lawyers knew it would be bad press for the pro abortion groups..... So, they argued it on the basis of right to privacy, and presto chango..a liberal court made legal Abortion the law of the land. Was I clear?
Yes, the constitution sets guidelines within which the government must operate.
