Well to be safe atleast go 1000, i know it may seem much but if u derestrict your moped to early it will pretty much tear up ur pistons and the inside of ur engine, if u drive atleast 1000 ur "breaking in" period is usally done, that's just means the rings that fit around ur pistons are sealed in so its less likely to break.
I have a four year old 50cc moped, it has 11,000 miles on the clock, i have never had to have it repaired and it is still working perfectly.

It depends on how many "cc" it has. If the moped if under 50cc than yes it's legal, but if the moped is over 50cc than no, is's illegal.
